Quotes are good for 30 days. Should you desire to book, we require a nonrefundable 50% deposit to secure your date. You may pay online after completing this form. Thank you for your consideration. We look forward to working with you!
1. Agreement/Jurisdiction: We, the "Photographer," will do our best to provide you, the "Client," with top-quality photographs of your wedding. This contract outlines our terms. In the unlikely event of a disagreement, we would prefer to solve it as one good citizen to another, but in the event we need to involve the legal system, any arbitration will take place within Maricopa County, Arizona. If we have to enforce this contract, you as the Client are responsible for any money we need to pay to accomplish this enforcement. 2. Deposit and Payment. We require a non-refundable deposit of 50% of the total photography fee to reserve your date. The remaining balance needs to be paid when we arrive at your wedding before we can start taking pictures. Bounced checks will incur an additional $35 fee. If you are unable to make payment, we keep the non-refundable deposit and have no further obligation to you. 3. Cancellation. If you need to cancel, we keep the non-refundable deposit. 4. Reschedule. If you need to reschedule your wedding, we can apply the balance of the deposit towards your new date, provided we are available. If we are not available, we keep the non-refundable deposit and you are free to seek other photography services. If our rates have changed between your original booking and the date you reschedule, the new rates will apply. 5. Emergencies. We understand emergencies can happen. If you have a family emergency that forces a cancellation, we will refund your deposit. We apologize, but we may ask for written proof, such as a doctor's note. We don't like having to ask for proof, but unfortunately, we've had some bad experiences in the past. We hope you understand. 6. Limits of Liability. While every reasonable effort will be made to produce and deliver outstanding images of your wedding, in the event we are unable to perform the duties outlined in this Agreement due to fire or other causality, acts of God or nature or terror, or other cause beyond our control, we will return any money you have paid us, but we shall have no further obligation to you beyond that. This limitation on liability also applies to any loss or damage of photographs or failure to deliver photographs for any reason. 7. Lost/Never Received Orders. We mail image disks shortly after processing is complete, however we are not responsible for loss in the mail. Should you fail to receive your disks, we will gladly send a replacement, but no refund will be given. 8. Competent Substitute. Although it is very unlikely, if joesvisuals.com photographers are unable to attend your event, another competent photographer may be sent as a substitute. You have the option of declining the substitute photographer, resulting in terminating this Agreement and receiving a full refund of any money you have paid towards photography services. 9. Outside Interference. We are not responsible for compromised coverage if guests or other vendors interfere with photography. 10. Exclusivity. In order for us to do the best job possible, we need to be the exclusive professional photographer for your wedding. Additional professional photographers are allowed only with our prior written consent. Guest photographers are welcome as long as they do not interfere with our work. 11. Harassment. It is your responsibility to ensure the appropriate behavior of your guests. If we experience any threatening, hostile, or offensive behavior from anyone at your event, we have the right to end services and leave immediately. If this happens, no refund will be given and we will not be held responsible for incomplete coverage. 12. Coverage. We provide coverage for the dates and continuous hours specified in this Agreement. We will make every effort to take requested pictures, however because a wedding is an uncontrolled event, we are not responsible for specific poses or pictures that cannot be delivered. These include, but are not limited to, compromised coverage due to bad weather conditions or guests showing up too late to appear in pictures. 13. Image Selection. We are the sole and exclusive authority in selecting which images will be delivered. 14. Image Count. Every reasonable effort will be made to deliver as many quality images as possible. However, because a wedding is an uncontrolled event, no specific image count can be promised. 15. Image Format. Images are delivered in either low resolution or high resolution JPEG form depending on what you have paid for. Digital negatives are not part of this agreement and are not offered. 16. Image Processing Limits. All images include minor touch-ups for color correctness and exposure. Any other modifications, including but not limited to body sculpting and object removal, are not included and involve anadditional per image charge. 17. Online Image Availability. Images will be made available for online ordering for a period of 90 days. Once this time period expires, unless other arrangements have been made, your images will be removed from the online server to make room for other clients' images. 18. Model Release. By agreeing to these terms, you grant us the irrevocable right to use the photographs in all forms, in all media, and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful, tasteful purpose. We have the right to grant use of the images to third parties, and all compensation for use and credit for the images remains with us. 19. Guest Release Liability. In rare cases, wedding guests may become unhappy with the use of photos in which they appear. We are not responsible for any damages or liability arising from your guests' objections to the use of yourwedding photos. Should legal action arise, you agree to defend us and be responsible for any legal fees and expenses arising from your guests' objections to use of your photos. 20. Copyright. All photographs taken by joesvisuals.com remain our sole property and are protected by U.S. copyright laws. 21. Reproduction. You agree to purchase all prints directly from us unless you have purchased high resolution digital files. If we find out you have printed, scanned, copied, or reproduced the images in any way without proper permission, you will be charged $300 per image per usage to be paid to us. If high resolution digital files arepurchased, we will provide you with a written release for printing, however copyright and ownership of the images remains with us. 22. Print Liability Limitation. We contract with high quality professional photo labs to print our photos and, while we will work with the lab to ensure any errors in your print order are corrected, we are not responsible for print quality, print delivery, or print accuracy. Sorry but no refunds will be given for prints. 23. Print Credits and Discounts. Print credits can only be used one time and are only good for the wedding couple. Discounts apply to everyone on all print orders placed within the first 30 days after your event. 24. Use of Images. You may use these images solely for private sharing amongst family and friends. You may not use these images for advertising, promotion, monetary gain, or any other type of commercial, editorial, or retail activity without our written permission.
